CC2640: FCC Cert Inquiries

Hello Team,

I have a customer who is trying to obtain FCC certification for their design using  both the CC2640 and CC2640R2F versions along with this antenna (). A couple questions have come up during the test process and we'd appreciate your input.

1.) What is the max TX power allowed by the FCC in Dbm? The datasheet seems to state +5 dBm yet in their given scenario the lab  measured 5.59dBm to which they add 5.3 dbi for the antenna gain (see link above) and since the total is over 6dBm it is over the FCC limit we were asked to set the cc2640 to -3Dbm instead.

2.) Does it make sense and is this the proper way to test and if not, what is? 

3.) If we assume that we have no control over reciever sensitivity, is there any other way to maximize range outside of provding the max certified transmission power.

4.) If we were to switch to the CC2640R2F version, would any of the answers to the above differ and how?
